TERMS OF USE

Please read these Terms of Use carefully before accessing or using this website (the “Site”).

 

ACCEPTANCE OF TERMS

  • By accessing or using this Site in any way, you agree to and are bound by the terms and conditions set forth in this document (“Agreement”) that Emvidia d/b/a Green Screen Jungle (“Green Screen Jungle”) may publish from time to time (collectively, the “Terms of Use”). If you do not agree to all of the terms and conditions contained in the Terms of Use, do not access or use this Site.
  • You further agree that Green Screen Jungle may change, alter, amend or replace all or any part of this Agreement at any time, and that such changes, alterations, amendments or replacements shall be effective as of the time of posting. Green Screen Jungle will provide notice on the Site of any material changes made to this Agreement and your continued use of the Site after the time of posting of such notice will constitute evidence of your acceptance of the changed, altered, amended or replaced Agreement. You further agree to regularly review this Agreement for such changes, alterations, amendments or replacements. If you do not agree with the changed, altered, amended or replaced Agreement, do not use or access the Site or information, material, products or services provided therein.
  • Minors and children (persons under the age of 18) are not eligible to use the Site unsupervised and we ask that minors and children do not register for an account or submit any personal information to us. By using this Site unsupervised, and/or registering for an account or purchasing a license to any content on the Site, you warrant that you are 18 years of age or older.

 

 

INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS

 

  • All videos, images and other material on this Site (collectively the “Content”) are protected by copyright, trademark, patent, trade secret and other intellectual property laws and treaties in the United States and internationally.
  • You acknowledge that should you enter into the licensing agreement to use any of the Site’s Content hereinafter, the “License Agreement”), it is a non-exclusive, revocable, non-transferable license.
  • Except as through the License Agreement, Green Screen Jungle does not grant any express or implied permission to use any of its Content.
  • This Site and its Content are intended for customers of the Site. You may not use this Site or the Content for any purpose not related to your business with Green Screen Jungle. You are specifically prohibited from: (a) downloading, copying, or re-transmitting any or all of the Site or the Content without, or in violation of, the Green Screen Jungle License Agreement; (b) using any data mining, robots or similar data gathering or extraction methods; (c) manipulating or otherwise displaying the Site or the Content by using framing or similar navigational technology; (d) registering, subscribing, unsubscribing, or attempting to register, subscribe, or unsubscribe any party for any Green Screen Jungle product or service if you are not expressly authorized by such party to do so; and (e) using the Site or the Content other than for its intended purpose, as determined solely in Green Screen Jungle’s discretion, including but not limited to, to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy) of others, and/or to publish, post, distribute or disseminate any defamatory, infringing, obscene, pornographic, sexual, indecent or unlawful material or information.

 

 

INFRINGEMENT CLAIMS / DMCA NOTICES

 

  • If you believe that any image or other material made available by Green Screen Jungle infringes upon any copyright that you own or control, you may notify Green Screen Jungle in the manner set forth in our DMCA Copyright Infringement Notice Policy.

 

LIMITATIONS

  • You agree that you shall not:
  1. Engage in any conduct that shall constitute a violation of any law or that infringes the rights of Green Screen Jungle or any third party.
  2. Violate any applicable laws or regulations related to the access to or use of the Site, or engage in any activity prohibited by the Terms of Use.

 

USE OF CONTENT AND TERMINATION OF USE

  • Content will only be made available to users who enter into Licensing Agreement with Green Screen Jungle. Unless you enter into the License Agreement with Green Screen Jungle, you may not download, distribute, display and/or copy any Content.

 

  • Green Screen Jungle reserves the right to revoke this license at any time for any reason.

 

  • Green Screen Jungle may block, restrict, disable, suspend or terminate your access to all or part of the Site and Content at any time in Green Screen Jungle discretion, without prior notice or liability to you.

 

WARRANTY DISCLAIMER

  • Your access to and use of the Services or any Content is at your own risk. You understand and agree that the Site and Content are provided to you on an “AS IS” and “AS AVAILABLE” basis.

 

  • THE SITE AND CONTENT ARE PROVIDED BY GREEN SCREEN JUNGLE UNDER THESE TERMS OF USE WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, GREEN SCREEN JUNGLE MAKES NO WARRANTY THAT: (i) THE SITE WILL MEET YOUR REQUIREMENTS; (ii) ACCESS TO THE SITE WILL BE UNINTERRUPTED; (iii) THE QUALITY OF THE SITE WILL MEET YOUR EXPECTATIONS; AND (iv) ANY ERRORS OR DEFECTS IN THE SITE, SERVICES OR MATERIALS WILL BE CORRECTED.

 

INDEMNITY

  • To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Green Screen Jungle, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site and Content; ii) your violation of any term of these Terms of Service; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms of Service and your use of the Site and Content.

 

CONTROLLING LAW AND JURISDICTION

  • These Terms of Use and any action related thereto will be governed by the laws of the State of New York without regard to or application of its conflict of law provisions or your state or country of residence. You and Green Screen Jungle each agree that any and all disputes or claims that have arisen or may arise between you and Green Screen Jungle relating in any way to, or arising out of this Agreement or your use of or access to the Site and Content, shall be resolved exclusively through final and binding arbitration within the State of New York. The Federal Arbitration Act governs the interpretation and enforcement of this Agreement to Arbitrate.

 

ENTIRE AGREEMENT

  • These Terms of Use, combined with the Licensing Agreement and Privacy Policy are the entire and exclusive agreement between Green Screen Jungle and you regarding your use of the Site and Content.
